The largest problem with wage garnishment is that you are probably already struggling with debt and now up to 25% of your net income can be taken each pay period. How are you supposed to pay your bills now? For some it is possible to tighten the belt and still be able to make the mortgage payment or rent each month while still having money to eat and pay other bills. Unfortunately for most it just makes things worse financially. The good news is that there are a number of solutions and bankruptcy is one of them. Others solutions include settling the judgment, but you have very little negotiating power given that your creditor went through the time and expense of obtaining a judgment against and the time and expense to enforce that judgment by garnishing your wages. Another solution is offering to make monthly payments to the judgment creditor instead of the money being taken out of your check. The idea is that a payment schedule is set up that is less each month than what could be garnished from your check each pay period. Again, the judgment credit may not be too inclined to do this given that they are getting paid each month anyway. Lastly you can file bankruptcy and stop the garnishment of your wages and discharge the judgment once and for all.
