If a debt collector tells you to pay more than the debt you owe you may be able to receive damages. If a debt collector tells you to pay an amount that you do not legally owe you may be able to collect damages. If a debt collector calls you over and over again that is harassment and you may be able to collect damages. If a debt collector uses threatening language, obscene language, profane language or abusive language you may be able to collect damages. A debt collector can only contact you during a reasonable hour. What is reasonable is after 8:00 a.m. or a before 9:00 p.m. If you tell the debt collector that a time is not convenient for you they should not then call you at that time. Violence or threat of violence should never be used to collect a debt.

A debt collector should not threaten to take an action that the debt collector cannot take or will not take. A debt collector should not threaten to sue you, send you to jail, take your car or stuff, garnish your wages, and make you lose your job or destroy your credit. A debt collector should not call and tell and third party about your debt unless you have given express permission for them to contact the third party. A debt collector can contact your attorney, the actual creditor you incurred the debt with, the creditor’s attorney, a reporting credit agency or your spouse. A debt collector cannot continue to call someone who knows you over and over again to find out your location, unless the debt collector believes the location the third party gave was not accurate. If the debt collector knows you cannot receive calls at work because your employer does not allow it they cannot call.
