A common question is how long will the bankruptcy take? There are a three different distinct periods when filing a Chapter 7 bankruptcy petition. First, counsel is retained and attorney fees are paid. After attorney fees are paid in full it is time to provide all of the documents necessary to draft a complete and accurate bankruptcy petition and then complete the required credit counseling course. Generally from the time the actual petition for bankruptcy is filed with the Bankruptcy Court, a Chapter 7 bankruptcy case will take three to four months. Once the bankruptcy petition is filed, the 341 meeting of the creditors will be scheduled approximately 30-45 days after the petition is filed. You will have 45 days after the meeting of the creditors to complete the second required course, financial management. After the 341 meeting is concluded it will take 45-90 days for the Bankruptcy Court to enter the order discharging your debt and issuing the final decree and close the case.

How long a Chapter 13 bankruptcy case will last is more complicated. Generally, a Chapter 13 repayment plan will be from 3 to 5 years. Generally a Chapter 13 bankruptcy is complete after the Bankruptcy Court confirms the Chapter 13 Plan. Depending upon the complexity of the Chapter 13 Plan and reorganization of debts, confirmation can take anywhere from two to three months or longer. Generally the 341 meeting of the creditors will be scheduled for a date 30 to 60 days after the petition is filed with the Bankruptcy Court.
