Chapter 7 bankruptcy cases are liquidation of assets cases. If there are any assets that cannot be exempted or protected, those assets are turned over to the trustee to liquidate and the funds obtained paid to those who debts are owed to. California has generous exemptions to help protect your assets. If there are assets that cannot be protected it is not the end of the world. The catch is you must have some disposable income in order fund a Chapter 13 plan. In a Chapter 13 plan you can pay the equivalent of the asset over three to five years depending upon your income. In a Chapter 13 case there is also a 341 Meeting of the Creditors. There is also a confirmation hearing to approve or confirm the Chapter 13 plan. Hopefully a confirmation hearing is not actually necessary and the standing Chapter 13 trustee will recommend confirmation of the Chapter 13 plan.
