What is Garnishment?

The whole point in filing bankruptcy is to get rid of burdensome debts. The most burdensome circumstance is when your income is being taken away from you. Garnishment can take up to 25% of your NET income. Not your gross income but your net income. When up to 25% of your net income is taken away each month it hurts. The good news is that there is help. Bankruptcy will make it all go away and give you the fresh start you deserve. As soon as your bankruptcy case is filed the garnishment of your wages will be permanently discontinued. We will fax notice of the bankruptcy filing to your payroll department, the sheriff’s department and the law firm the creditor is using to enforce the judgment against. The creditor should then file notice of termination of the earning withholdings order.

If the sheriff’s department is holding any of your wages they will return the wages to you. Different departments have different procedures for the return of garnished wages once the garnishment has been terminated. To ensure your money is returned as soon as possible the bankruptcy case needs to be filed as soon as possible after the check date of the garnished wages.

We must also exempt or protect the amount of your wages already taken by listing them in schedule B and schedule C. To make sure you keep the returned wages we must exempt them from your bankruptcy estate an protect your wages just like a car or money in your bank account at the time your case is fild.
