What is Garnishment?

The process of filing bankruptcy has become more complicated given the creation of the means test and the additional course requirements. The means test must be completed in all consumer bankruptcy cases. To complete the means test we will need proof of your income for the six months prior to the filing of the bankruptcy case. Then certain standard deductions for living expenses, healthcare, family support, education expenses and transportation are deducted from your average income. The idea is that the means test will be able to determine if you have the ability to pay back a portion of your unsecured debts.
