The Means Test takes a six-month average of your gross income and multiples the average by 12 to determine what your median income is for a year. If your gross income is under the median income for the number of people in your household, you will automatically qualify to file a Chapter 7 bankruptcy depending upon your assets and expenses. If your income is over the median income for the number of people in your household, you may still qualify to file a Chapter 7 bankruptcy if you can pass the Means Test. To pass the Means Test certain expenses that can be included as deductions to your income are included in the Means Test. If you have disposable income after all reasonable deductions are included, then you do not pass the means test.
